Family Options Providers (“we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information of the people we serve. This Privacy Policy explains how we collect, use, disclose, and safeguard information through our website at familyoptionsproviders.com (the “Site”) and through related online interactions, communications, and forms. By accessing or using the Site, you agree to the practices described in this Policy.

Family Options Providers is a licensed behavioral health and addiction recovery center that has been serving West Virginia communities since 1994. We provide compassionate, accessible care, including counseling, medication-assisted treatment (MAT), and telehealth services, to individuals navigating mental health and substance use challenges.

Important Note About Health Information and HIPAA

This Privacy Policy applies to information collected through our Site and through general business communications. It does not replace our HIPAA Notice of Privacy Practices, which separately governs how we use and disclose Protected Health Information (PHI) created or received in connection with treatment, payment, and healthcare operations. If you are a current or prospective patient, please review our Notice of Privacy Practices for a full description of your rights regarding PHI under the Health Insurance Portability and Accountability Act (HIPAA). In the event of any conflict between this Policy and our Notice of Privacy Practices with respect to PHI, the Notice of Privacy Practices controls.


Information We Collect

Information You Provide Directly

We collect information you submit through contact forms, intake forms, insurance verification forms, scheduling tools, account registration, surveys, online assessments and any other interactive feature on the Site. This may include your name, mailing address, email address, telephone number, date of birth, health or diagnostic information, insurance information, the services you’re inquiring about and any other details you choose to share with us.

Information Collected Automatically

When you visit the Site, we automatically collect technical information including your IP address, device type, browser type and version, operating system, referring URLs, pages viewed, time spent on pages, and approximate location derived from your IP address. We collect this information using cookies, pixel tags, server logs, and similar technologies described below.

Information From Third Parties

We may receive information about you from third parties such as referral sources, healthcare providers, insurance carriers, advertising platforms, analytics vendors, public databases, and social media platforms when you interact with our content, consistent with applicable law and any consents you’ve provided.

Categories of Sensitive Personal Information

To the extent we collect or process the following categories of sensitive personal information, we do so only as described in this Policy and as permitted by applicable law: precise geolocation; racial or ethnic origin; religious or philosophical beliefs; mental or physical health diagnoses; sexual orientation; biometric or genetic data used for identification; information concerning a known child; contents of mail, email, or text messages where we are not the intended recipient; financial account information; and government-issued identifiers. We don’t process sensitive personal information for purposes other than those permitted by applicable law without your consent.


Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, remember preferences, analyze traffic, measure the effectiveness of our outreach, and support advertising. You can control cookies through your browser settings. Many browsers and browser extensions transmit a Global Privacy Control (GPC) signal, and we honor GPC signals as a request to opt out of the sale or sharing of personal information for cross-context behavioral advertising where required by applicable state law.

Third-party tools we use may include Google Analytics. These vendors may collect information about your use of the Site and other websites over time to deliver advertising or measure performance. Their practices are governed by their own privacy policies.

Online Tracking Technologies and Health Information

We follow guidance from the U.S. Department of Health and Human Services Office for Civil Rights (HHS OCR) on the use of tracking technologies by HIPAA-regulated entities. We don’t permit cookies, pixels, web beacons, software development kits, or similar tracking technologies on our patient portals, scheduling pages, intake forms, or other authenticated or treatment-related pages in any manner that would result in the disclosure of Protected Health Information (PHI) to a third-party tracking vendor without a Business Associate Agreement (BAA) in place. We assess each tracking tool we use for compliance with the HIPAA Privacy and Security Rules, including risks to electronic PHI, and we configure tools to limit data shared with vendors to what is permitted by applicable law.

How We Use Information

We use the information we collect to operate, maintain, and improve the Site; respond to inquiries and requests; deliver and improve our services; process transactions and payments; verify eligibility and benefits; communicate with you about appointments, accounts, and service updates; send marketing communications consistent with applicable law and your preferences; comply with legal, regulatory, and accreditation obligations; prevent fraud and protect the security of our Site and users; and conduct internal research and analytics.

We don’t process personal information for purposes that are incompatible with the purposes described above without providing notice and, where required, obtaining consent.


How We Share Information

We share information with service providers and processors who help us operate, including hosting providers, electronic health record vendors, payment processors, insurance clearinghouses, communication platforms, analytics providers, and advertising platforms. These parties are contractually required to protect your information and use it only for the purposes we authorize. We have Business Associate Agreements in place with vendors that handle PHI and Qualified Service Organization Agreements with vendors that handle 42 CFR Part 2 records.

We may also disclose information when required by law, in response to valid legal process, to protect the rights, property, or safety of Family Options Providers, our customers, our staff, or the public, in connection with a corporate transaction such as a merger or acquisition, with your consent, and as otherwise permitted by applicable law.

Sale and Sharing of Personal Information

We don’t sell personal information for monetary consideration. We may share certain limited identifiers and online activity data with advertising and analytics vendors to deliver and measure marketing, which may qualify as “sharing” or a “sale” under certain state laws. You have the right to opt out of these activities as described in the “Your Privacy Rights” section below.

Automated Decision-Making and Profiling

We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.

Children’s Privacy

The Site is intended for adults 18 years or older. We comply with the Children’s Online Privacy Protection Act (COPPA) and the FTC’s amended COPPA Rule, including the requirements that took effect in 2025 and 2026. We don’t knowingly collect personal information directly from children under the age of 13 without verifiable parental consent.

When parents and guardians submit information about a child for the purpose of inquiring about or receiving services, that information is collected from the parent or guardian and used in connection with delivering those services. We obtain separate verifiable parental consent before disclosing a child’s personal information to third parties for purposes other than delivering the requested service, and we don’t use a child’s personal information for targeted advertising. Parents and guardians may review, request deletion of, or refuse further collection of their child’s information by contacting us using the information at the end of this Policy.

Communications, Calls, and Text Messages

By providing your phone number, you consent to receive calls and text messages from Family Options Providers related to your inquiry, account, scheduling, services, billing, and service updates, including communications sent using automated technology where permitted by the Telephone Consumer Protection Act (TCPA) and applicable state law. By providing your email address, you consent to receive email communications consistent with the CAN-SPAM Act. Message and data rates may apply. You may opt out of marketing text messages at any time by replying STOP and may opt out of marketing emails using the unsubscribe link in any marketing email. Opting out of marketing communications won’t affect transactional or service-related communications.

Data Security

We maintain reasonable administrative, physical, and technical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. For Protected Health Information, we follow the HIPAA Security Rule. No method of transmission over the Internet or method of electronic storage is fully secure, and we can’t guarantee absolute security.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal, regulatory, accounting, accreditation, and reporting obligations, to resolve disputes, and to enforce our agreements. Medical records are retained according to applicable state and federal record retention requirements. When personal information is no longer needed, we securely delete or de-identify it consistent with applicable law.

Patient Testimonials and Reviews on the Site

Any patient testimonials, reviews, photographs, or stories published on the Site are posted only with a written authorization that meets the requirements of the HIPAA Marketing Rule (45 CFR § 164.508) and, where applicable, 42 CFR Part 2. You may revoke your authorization at any time by contacting us at info@familyoptionsproviders.com, and we’ll remove the content prospectively.


Your Privacy Rights

Depending on your state of residence, you may have one or more of the following rights regarding your personal information. As of 2026, comprehensive consumer privacy laws are in effect in California, Virginia, Colorado, Connecticut, Utah, Iowa, Indiana, Tennessee, Texas, Oregon, Montana, New Jersey, Delaware, New Hampshire, Minnesota, Maryland, Kentucky, Rhode Island, Nebraska, and others. Specific rights and exceptions vary by state, and we’ll honor any rights granted under the law of your state of residence even if not specifically listed here.

Common Rights

Subject to verification and applicable exceptions, you may have the right to:

  • Confirm whether we process your personal information and access the specific pieces or categories we hold.
  • Obtain a portable copy of your personal information.
  • Correct inaccurate personal information.
  • Request deletion of your personal information.
  • Opt out of the sale or sharing of personal information and out of targeted advertising.
  • Opt out of profiling that produces legal or similarly significant effects.
  • Limit the use and disclosure of sensitive personal information.
  • Appeal a decision we make in response to your request.
  • Be free from discrimination or retaliation for exercising these rights.
Other State-Specific Rights and Disclosures

The state laws referenced above contain provisions that vary in scope, applicability thresholds, definitions, and enforcement. For example, Colorado, Connecticut, and Oregon honor universal opt-out mechanisms, while California requires both a “Do Not Sell or Share” link and recognition of the GPC signal. Texas requires specific notice in retail and online contexts. Several states require recognition of authorized agents and provide an internal appeal process if we deny a request. We will honor the rights and procedures applicable in your state of residence as required by law.

Residents of Other States

If you reside in a state that has not enacted a comprehensive consumer privacy statute as of the effective date of this Policy, we extend many of the same privacy rights described above to you as a matter of practice. We will respond to privacy requests within reasonable timeframes and provide an appeal process if we decline a request. We will also provide notice of any security breach affecting your personal information as required by applicable state law.

How to Exercise Your Rights

We will verify your request through reasonable means, which may require you to confirm information we already have on file. You may designate an authorized agent to make a request on your behalf, subject to verification and any additional requirements under applicable law. We won’t discriminate against you for exercising any of these rights. We’ll respond within the timeframes required by applicable law, generally within 45 days, with one extension where permitted.

Right to Appeal

If we decline a request, we’ll notify you of our reasoning and your right to appeal. To appeal, contact us at info@familyoptionsproviders.com within the time period required by applicable law. We’ll respond to appeals within the timeframes required by your state’s law. If your appeal is denied, you may have the right to contact your state attorney general or other applicable regulator.

Third-Party Links

The Site may contain links to third-party websites, resources, and services we don’t operate. We aren’t responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any site you visit.

Do Not Track and Global Privacy Control

Some browsers transmit “Do Not Track” signals. Because there’s no consistent industry standard for responding to these signals, we don’t currently respond to them. We do honor Global Privacy Control signals as a request to opt out of the sale or sharing of personal information for cross-context behavioral advertising where required by applicable law.

Out-of-State and International Users

The Site is operated in the United States and is intended for users in the United States. If you access the Site from outside the United States, you understand that your information will be processed in the United States, where data protection laws may differ from those in your jurisdiction.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, and other factors. When we do, we’ll revise the “Last Updated” date above and post the updated Policy on the Site. Material changes will be communicated through a notice on the Site or other reasonable means. Your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.
